The UAE authorities have announced the enforcement of a midday break policy starting from June 15 to September 15, 2024.
Midday Break Implementation
This marks the 20th consecutive year of implementing this regulation. The policy prohibits work under direct sunlight and in open-air areas across the UAE every day from 12:30 p.m.p.m. to 3:00 p.m. p.m. This initiative aims to protect workers from the intense summer heat and ensure their health and safety during the hottest part of the day.
The Ministry of Human Resources and Emiratisation (MoHRE) has specified strict penalties for non-compliance. Any employer found violating the midday break policy will face a fine of Dh5,000 per employee working during the prohibited hours. The fines can escalate up to Dh50,000 if multiple employees are found working during this period. The authorities have emphasized that adherence to this policy is crucial for safeguarding workers' well-being.
Exemptions and employeremployer responsibilities
Certain jobs are exempt from the midday break policy due to the nature of their work. Exempted tasks include those related to water supply or electricity maintenance, traffic management, road works such as laying asphalt or pouring concrete, and other essential services. Companies engaged in these activities must obtain a permit to continue operations during the midday break hours.
Employers are also required to take specific measures to ensure the safety and comfort of employees who must work inin direct sunlight. This includes providing shaded areas or parasols, ensuring job sites are equipped with fans, and supplying sufficient drinking water and first aid equipment. These provisions are necessary to mitigate the risks associated with working in extreme heat.
Mohsin Al Nassi, serving as the Assistant Undersecretary for Inspection Affairs at MoHRE, emphasized the significance of the midday break. He noted that the practice has become deeply rooted in the UAE’s business community and private-sector firms. This is attributed to its vital role in safeguarding the health and safety of workers, whom he regards as the most precious asset of any company.
In addition to enforcing the policy, the ministry will conduct awareness campaigns and field visits to various work sites. These initiatives are designed to educate employers and employees about the importance of the midday break and to ensure compliance with the regulations. The field visits will allow inspectors to monitor adherence and provide guidance on best practices for worker safety during the summer months.
The midday break policy is a significant step towards enhancing worker protection in the UAE. By limiting exposure to extreme heat, the policy not only improves health outcomes for workers but also promotes a safer and more humane working environment.
