UAE court obligated a Jeweler to pay 270,000 dirhams to a woman

asmaa - | Arab News

A recent legal development involved the Abu Dhabi Family, Civil and Administrative Claims Court rendering a noteworthy verdict. The court ordered the proprietor of a gold establishment to provide 270,000 dirhams in indemnification to a woman. The decision at hand was a consequence of the defendant's conviction for the wrongful taking of a gold bullion that belonged to the plaintiff and was valued at 250,000 dirhams.

In a recent legal development, the Abu Dhabi Family, Civil, and Administrative Claims Court delivered a significant verdict, compelling a gold shop owner to indemnify a woman with the sum of 270,000 dirhams. This ruling stemmed from the defendant's conviction for appropriating a gold bullion valued at 250,000 dirhams, belonging to the plaintiff.

The Plaintiff's Grievance

The case unfolded when a woman initiated legal proceedings against a jeweler, seeking restitution of 250,000 dirhams and compensation amounting to 50,000 dirhams for material losses incurred. She alleged that the defendant had unlawfully seized her gold bullion after duping her into entrusting him with her monthly earnings. Despite her repeated demands for reimbursement, the defendant procrastinated, leading to his subsequent criminal conviction. As a consequence, he received a one-year prison sentence and deportation, albeit with a three-year suspension period.

Aligning criminal and civil proceedings

In its verdict, the court underscored the convergence between criminal and civil lawsuits, emphasizing that the defendant's criminal conviction for fraud and deception mirrored the core of the plaintiff's civil complaint. The court's scrutiny of the case documents revealed the defendant's culpable negligence in withholding the confiscated gold, thus establishing liability. Furthermore, the plaintiff's financial losses, stemming from the denial of her rightful gain and the inability to utilize or profit from the gold's value, were duly acknowledged.

The court's ruling was clear and resolute. It mandated the defendant to reimburse the plaintiff with the full value of the gold bullion, totaling 250,000 dirhams. Additionally, recognizing the plaintiff's damages, a compensation award of 20,000 dirhams was decreed. This decision not only sought to rectify the material losses incurred by the plaintiff but also aimed to hold the defendant accountable for his negligent actions.

In essence, the court's verdict exemplifies the judiciary's commitment to upholding justice and ensuring accountability in civil matters. By aligning criminal and civil proceedings, the court effectively addressed the plaintiff's grievances and provided due compensation for the incurred losses. This ruling stands as a testament to the legal system's capacity to safeguard the rights of individuals and uphold the principles of fairness and equity.
