UAE Court Rejects Clinic Claim for 230K Dirhams Against Plastic Surgeon

The Abu Dhabi Family, Civil, and Administrative Claims Court recently made a significant ruling in a lawsuit brought by a medical clinic against a plastic surgeon.

The clinic sought compensation totaling 230,000 dirhams, alleging losses and damages resulting from errors attributed to the surgeon in her interactions with patients.

Details of the Lawsuit

The clinic's lawsuit specifically demanded 90,000 dirhams for notice compensation and an additional 140,000 dirhams for losses and damages incurred while attempting to rectify the errors allegedly caused by the surgeon. The lawsuit also included expenses and sought expedited enforcement of the court's ruling.

In its ruling, the court meticulously dissected the clinic's claims. It was noted that the essence of the clinic's demand was to seek compensation for damages arising from the surgeon's departure from her position and alleged errors in her medical services.

However, the court pointed out that a prior ruling from the Labor Court had already rejected the clinic's claim for notice compensation. This rejection stemmed from the fact that the surgeon had voluntarily terminated her contract, absolving her of fault in the matter. Additionally, the court found no evidence to support the clinic's allegations of medical errors by the surgeon. Notably, the clinic did not request an investigation into these allegations, further undermining the basis of its lawsuit.

Consequently, the court ruled to reject the clinic's lawsuit in its entirety. Furthermore, it obligated the clinic to cover the expenses, fees, and legal costs associated with the proceedings. This decision underscores the importance of substantiating claims with concrete evidence and conducting thorough investigations before initiating legal action.

The clinic's demand for 90,000 dirhams in notice compensation and 140,000 dirhams for losses attributed to the surgeon reflects the significant financial implications it believed it suffered due to the surgeon's actions. However, the court's ruling highlights the need for a robust legal foundation and compelling evidence to support such claims in a court of law.

This case serves as a valuable lesson in the legal landscape, emphasizing the importance of due diligence and evidence-based claims.
